These Terms and Conditions ("Agreement") outline the terms governing an arrangement between two parties ("Service Provider" and "Client") for the provision of services ("Services"). By engaging in a service agreement, both parties agree to the following terms:
1. Booking Confirmation
A booking is only confirmed when payment is received by one of the following methods:
- VemYou Platform Payment
- Invoice Payment (via automatically generated invoice link)
- Cash Payment or Bank Transfer
Confirmation constitutes a binding agreement between the Booker and the Artist under these terms.
A gig protection fee of 5% is added to each confirmed booking. This ensures both the musician and venue are protected by the VemYou system, using system intelligence. This includes automatic invoicing and payments, check-in and check-out features, use of the digital wallet system, and cancellation.
2. Cancellation Policy
If the Booker cancels within 48 hours of the scheduled start time, the full agreed fee is payable to the Artist.
Cancellations made more than 48 hours prior will result in no penalty and a full refund.
All cancellations must be submitted via the VemYou platform or in writing with time stamped proof.
3. Payment Methods and Terms
a. VemYou Platform Payment
When selecting this option, the Booker agrees to VemYou’s platform terms.
Funds are securely held in a digital wallet until the gig is completed.
Completion is confirmed using the check-in and check-out process:
- The Booker shares a check-in code with the Artist upon arrival.
- The Artist checks out via the platform at the end of the performance.
- If the Artist fails to check out, a 24-hour buffer applies. If no dispute is raised by the Booker within that time, funds will be released.
- If a dispute is lodged, payment will be paused pending VemYou’s review.
b. Invoice Payment
An invoice is automatically generated when the Artist accepts the booking.
The gig is not confirmed until the invoice is marked as paid.
Payment via the invoice link is held in a secure digital wallet.
Funds are released under the same check-in, check-out, and dispute rules described above.
4. Check-In and Check-Out Process
Both the Booker and Artist are jointly responsible for completing this process.
Check-in occurs when the Booker provides a platform-generated code to the Artist at the start of the gig.
Check-out is completed by the Artist upon finishing the performance.
If the Artist forgets to check out:
- A 24-hour window opens for the Booker to raise a dispute.
- If no dispute is made within that time, payment is auto-released.
- Disputes must be raised within 24 hours of the scheduled end time.
5. Dispute Resolution
Disputes may be submitted via the VemYou platform and must include:
- Reason for the dispute (e.g., no-show, major performance issue)
- Any relevant evidence (photos, messages, etc.)
VemYou will review internal platform data (check-in/out, communication logs) and issue a binding resolution.
Funds may be refunded or released based on the outcome of the dispute.
6. Responsibilities and Conduct
Artist Responsibilities
- Arrive on time and perform to a professional standard.
- Provide all required equipment unless agreed otherwise.
- Complete check-out at the end of the performance.
- Raise any concerns or disputes in good faith and within the platform’s timeframes.
Booker Responsibilities
- Provide a safe, clean, and appropriate space for the performance.
- Ensure power access is available at the location.
- Supply any agreed requirements, which may include:
- Food and non-alcoholic beverages if the gig overlaps with mealtimes or extends over long durations.
- Scheduled breaks for the Artist (recommended every 45–60 minutes).
- Provide the check-in code upon Artist arrival.
- Follow all platform procedures for disputes or changes.
7. Liability and Indemnity
VemYou is not liable for any:
- Damage to property
- Injuries sustained
- Misconduct by either party
The Booker and Artist agree to indemnify each other and VemYou from any third-party claims arising from the gig.
Insurance (if desired) is the responsibility of the respective parties.
8. Legal Jurisdiction
These terms are governed by the laws of Queensland, Australia.
Any legal disputes outside of the VemYou platform will be subject to the jurisdiction of Queensland courts.
